Terms & waitlist conditions

These terms cover joining the OptiBreath waitlist, the warranty and returns that will apply once units ship, and the limits of what we claim the product does. We have tried to write them so that reading them is not a punishment.
01What joining the waitlist is
Joining the waitlist records your email address and, for the first 500 places, reserves you a Founding Edition allocation. It is not a purchase, it is not a pre-order, and it does not transfer title to anything.
No payment is taken and no card details are collected. Nothing on this site charges you. When production is confirmed we will email you an offer to buy, at which point a separate purchase contract is formed on its own terms. Ignoring that email costs you nothing.
A waitlist place is personal to you and cannot be sold or transferred. We may cancel places that appear to exist for resale.
02Leaving the waitlist
You can leave at any time — every email we send carries a one-click unsubscribe, or write to hello@optibreath.space. Leaving removes your place and deletes your address from the list.
If we cancel the programme or materially change the specification, we will email everyone on the list and say so plainly.
Once you have actually bought a unit, you have 60 days from delivery to return it for a full refund, for any reason or none, with return shipping paid by us. The unit should come back in a condition that reflects normal use; we are not going to argue about a scuff.
03Delivery dates
Founding Edition units are scheduled to ship in Q1 2027, with general availability in Q2 2027. These are estimates for hardware that is still being manufactured, and hardware schedules move.
If a date slips, we will email everyone on the list with the new date in the first line, along with the reason. Since you have paid nothing, a slipped date costs you nothing but patience — and you can leave the list at any point.
04Warranty
OptiBreath Core carries a three-year warranty and Pro a five-year warranty, from delivery, against defects in materials and workmanship. We will repair or replace at our option. Sensor modules and the battery are user-replaceable consumables and are covered for the same period against premature failure, but not against normal end-of-life.
The warranty does not cover damage from liquid ingress, physical impact, unauthorised modification of the hardware, or operation outside the stated environmental range.
These terms sit alongside your statutory rights as a consumer and do not replace or limit them.
05What the product claims
OptiBreath is a measurement instrument for environmental conditions. It is not a medical device. It does not diagnose, treat, monitor or prevent any disease or condition, and nothing on this site should be read as a medical claim.
The indicative decision-making index shown on this site and in the applications is a directional figure derived by interpolating published research findings. It is not a measurement of your cognition, it is not personalised to you, and it must not be relied on for any clinical, occupational-health, safety or compliance purpose.
Stated accuracy figures apply within the stated environmental ranges, after any required warm-up period and with calibration current. Where a reading must satisfy a regulatory or contractual requirement, use a unit calibrated against a traceable reference and read the certificate that came with it.
06Software, data and continuity
The instrument's core functions — every sensor, the display, local alerting, local history and, on Pro, the local API — operate without any network connection and without an account. We will not disable them, meter them, or place them behind a subscription at any future date.
OptiBreath Signal is an optional subscription. Cancelling it removes the analysis features and nothing else.
If we cease trading, we commit to publishing the local API specification, the service manual and the firmware signing tooling so that the instruments already in the field remain usable and repairable.
07Liability
We do not exclude liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.
Subject to that, our total liability arising from the product or these terms is limited to the amount you paid for the instrument. We are not liable for indirect or consequential loss, including lost profit or lost business decisions.
08General
These terms are governed by Irish law, and the courts of Ireland have non-exclusive jurisdiction. If you are a consumer, you keep the protection of the mandatory law of your country of residence.
